The "Off the Roll Tape Sculpture Contest" (“Contest”) is open only to legal residents of the U.S. and D.C. who are 16 years of age and older at the time of entry. Employees, officers, directors and agents of 3M Company (“Sponsor”), Hunter Public Relations, LLC, and their respective parent companies, affiliates, subsidiaries, advertising/promotional agencies, fulfillment companies and members of their immediate family (defined as spouse, parent, sibling, child and respective spouses regardless of where they reside) and/or persons living in the same household of such individuals (whether related or not), are ineligible to participate in the Contest in any capacity (including, without limitation, in Public Voting) or win a prize. Void where prohibited by law. The Contest is subject to all federal, state and local laws and regulations. An eligible individual as described herein is referred to as an “Entrant.”
Beginning on 1/27/12 at 12:00:01 a.m. Eastern Time (ET) and ending at 11:59:59 p.m. (ET) on 3/24/12 (“Contest Period”), a prospective Entrant may go online to www.OfftheRollContest.com (“Website”) and (a) accurately and truthfully complete all mandatory elements of the Official Entry Form, including full first and last name, street address (No P.O. Boxes), city, state, ZIP code, telephone number, date of birth, email address and (optional) number of rolls of tape (as described below) used to complete the sculpture; (b) upload one to three (1-3) photographs (each, a “Photos;” collectively, the “Photos”) in JPG or PNG format, of a size not exceeding 3MB, of an original sculpture personally created by the applicable Entrant using Scotch® Heavy Duty Shipping Packaging Tape; (c) input the name of the sculpture in English (up to 100 characters, including spacing); and (d) input between one and ten (1-10) sentences (each sentence must be unique and different) in English (up to 500 characters, including spacing) describing the original sculpture. All of the foregoing elements shall collectively be deemed an “Entry.”
Sponsor’s computer is the official clock for the Contest.
ADDITIONAL REQUIREMENTS OF ENTRY:
To be eligible for Contest judging and prize award, an Entry must meet, and each Entrant hereby warrants by submission of his/her Entry the truthfulness and accuracy of, the following additional requirements:
Each Entrant agrees to participate in scheduled public relations/media activities (e.g., media interviews, media appearances) prior to, during and after the selection of the winning Entries, if requested to do so by Sponsor.
Each Entrant also agrees to reasonably preserve his/her sculpture in the form depicted in his/her Entry through prize notification and acknowledges that Sponsor shall have the right to require that such sculpture be loaned to Sponsor for up to twenty four (24) months for display at Sponsor’s corporate headquarters or other public locations, with no additional compensation to such Entrant. Sponsor will be solely responsible for the retrieval, display and return of a sculpture, at no additional cost to the Entrant.
Entries will be preliminarily (and at any time, may subsequently be) screened for conformity with these Official Rules, including any written verification/documentation confirming the requirements and permissions specified herein (e.g., parent/guardian consents, in the case of minor Entrants) requested by Sponsor in its reasonable discretion and thereafter may be posted in a photo gallery (“Gallery”) on the Website. No correspondence regarding the screening, verification or judging status of Entries will be undertaken by Sponsor. Incomplete, unintelligible Entries and Entries that do not fully comply with all of the requirements set forth herein will be disqualified. Limit one (1) Entry per person. Without limiting anything set out elsewhere in these Official Rules, certain entries may be used by Sponsor and its agents for socializing and promotion purposes during the Contest Period. Use of an entry for socializing and/or promotional purposes is unrelated to the judging and does not imply or guarantee selection as a finalist or prize winner in the Contest. Entries will not be acknowledged or returned. Proof of submitting an Entry will not be deemed proof of receipt by Sponsor.
Round 1: PRELIMINARY INDEPENDENT JUDGING: On or about 4/2/12, an independent, qualified panel of judges will judge all eligible Entries received based on the following criteria:
The five (5) highest scoring Entries (provided a sufficient number of eligible entries are received) will advance to Round 2 of judging, which will be conducted via Public Voting as described below. In the event of a tie during Round One, the Entry with the highest score for Execution will be deemed the winner. In the unlikely event a tie still exists, the Entry with the highest score for Creativity will be deemed the winner. The judges’ decisions on all matters pertaining to judging are final and binding and are not open to appeal. If fewer than 5 eligible entries are received, all eligible entries will advance to Public Voting.
Round 2: PUBLIC VOTING: Beginning on 4/19/12 at 12:00:01 a.m. ET and ending at 11:59:59 p.m. ET on 5/2/12 (“Voting Period”), except as otherwise expressly prohibited in the ELIGIBILITY section above, members of the public who are legal residents of the U.S. and DC, 16 years of age and older at the time of voting, can go to the Website and follow the instructions to view and vote for the Entry posted in the Gallery that they believe should be the Grand Prize Winner by applying the following criteria: Creativity (60%) and Presentation (40%). Limit 10 votes per person/email address per day.
The two Entrants submitting the Entries that receive the most number of eligible votes will advance to Round 3: Final Independent Judging, subject to verification. The Entrants submitting the remaining three (3) Entries will be declared potential Second Runners-Up, subject to verification. Entrants are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to members of the public, as determined by Sponsor in its sole discretion.
In the event of a tie during Public Voting, the Entry with the highest score from Round 1 will advance to Final Independent Judging. In the event of a tie during Round One, the Entry with the highest score in Round 1 for Execution will advance to Final Independent Judging. In the unlikely event a tie still exists, the Entry with the highest score for Creativity will advance to final independent judging.
Round 3: FINAL INDEPENDENT JUDGING: After the two finalists have been selected through Public Voting (on or about 5/2/12) and verified as necessary, scores from the independent, qualified panel of judges will determine which entrant will be declared the Grand Prize Winner, based on the following criteria:
The Round 3 finalist with the highest scoring Entry will be declared the Grand Prize Winner, subject to verification. The Round 3 finalist who submitted the remaining entry will be deemed the First Runner Up, subject to verification. In the event of a tie during Round Three, the Entry with the highest score for Presentation will be deemed the winner. In the unlikely event a tie still exists, the Entry with the highest score for Creativity will be deemed the winner.
The judges’ decisions on all matters pertaining to judging are final and binding and are not open to appeal. Potential prize winners will be notified by phone or mail on or about 5/3/12.
PRIZES: One (1) Grand Prize of $5,000 will be awarded in the form a check written in the name of the Grand Prize winner. One (1) First Runner-Up Prize of $1,000 will be awarded in the form of a check written in the name of the first runner-up. Three (3) Second Runner-Up Prizes (3) of $500 will be awarded in the form of a check written in the name of each runner-up. Sponsor reserves the right, in its sole discretion, to substitute a prize of equal or greater value for any and all prizes. No other substitutions or transfer of prizes allowed unless specifically authorized by Sponsor. Limit 1 prize per person.
GENERAL: Winners are responsible for payment of any income taxes on prizes under applicable federal, state and local laws. Each Entrant submitting an Entry selected for Public Voting will be required to sign and return an Affidavit of Eligibility, Release of Liability, Assignment of Rights and a Publicity Release (where legal) (collectively, the “Eligibility Documents”), within 5 days of notification. If an Entrant is under 19 in NE/AL, 21 in MS or under 18 in U.S./D.C, his/her parent or legal guardian will be asked to confirm prior permission and consent to such Entrant’s participation in the Contest and agreement to these Official Rules by co-signing and returning the Eligibility Documents (where legal). The Eligibility Documents may additionally confirm an Entrant’s grant of the license to Sponsor in such Entrant’s sculpture as specified above. In the event of non-compliance with these requirements, an Entry may be declared ineligible and an alternate Entry selected for Public Voting. Without limiting the foregoing, in the event that a prize or prize notification is returned as undeliverable, such prize will be forfeited and prize will be awarded to an alternate Entry with the next highest score in Round Two and Round One (as applicable), at the Sponsor’s sole discretion.
By entering the Contest, each Entrant, on behalf of himself/herself, and his/her executors and heirs, agrees (a) to be bound and abide by these Official Rules and by all decisions of Sponsor, whose decisions are final and binding and not open to appeal; (b) to release, indemnify, defend and hold harmless Sponsor, Hunter Public Relations, and each of its and their parents, subsidiaries, affiliates, members, shareholders, agents, representatives, employees, suppliers, agencies, successors, assigns, licensors, advertising or promotional agencies and any prize-sponsoring agency (collectively, "Released Parties"), from any and all liability whatsoever in connection with or related to this Contest, including, without limitation, from any and all causes of action, liabilities, suits, claims (including but not limited to, third party claims that may be made against Entrant, and claims arising out of or relating to acceptance, receipt, possession or use/misuse of any prize, or any publicity or other public exposure of Entrant, including without limitation, claims concerning infringement or invasion of Entrant's privacy or publicity rights, or defamation, or acts undertaken in preparation for, or participation in, the Contest), cross-claims or counterclaims, costs, injuries, losses or damages or demands of any kind (including without limitation personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light) (collectively, "Claims"), WHETHER OR NOT ARISING FROM THE NEGLIGENCE OF A RELEASED PARTY; (c) that he/she has no right to bring, and covenants not to bring, any claim, action, or proceeding of any kind or nature whatsoever against the Released Parties; (d) to assume all risks, express or implied, associated with all Claims released above, including without limitation, all risks concerning entry into and participation in the Contest; and (e) that NONE OF THE RELEASED PARTIES HAVE MADE OR MAKE OR ARE RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION OR GUARANTEE, EXPRESS OR IMPLIED, RELATIVE TO THIS CONTEST OR A PRIZE, AND ALL PRIZES ARE TENDERED TO ENTRANTS ON AN "AS IS" BASIS. THERE ARE NO WARRANTIES THAT EXTEND BEYOND THE DESCRIPTION ON THE FACE OF ANY PROMOTION MATERIALS OR ANY PRIZE.
In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any promotion materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control.
Repetitive automated electronic submission of entries of any kind are prohibited, and any such entries will be disqualified.
Neither Sponsor nor its agents or representatives is responsible for (a) typographical errors, omitted details or any other errors submitted by Entrants, or errors in the printing of these Official Rules, the administration or fulfillment of the Contest or the announcement of prizes; (b) lost, late, illegible, incorrect, incomplete, misdirected, misaddressed, garbled or otherwise mutilated, stolen or delayed Entries; (c) errors, omissions, interruptions, deletions, defects, destruction, theft or unauthorized access to, or alteration of entries or other problems (whether due to technical problems, human error or any combination thereof); (d) telephonic, mechanical, electronic, hardware or software program, network, Internet or computer malfunctions, communications line or other failures, or difficulties of any kind, including without limitation, server malfunction or by any human error which may occur in the processing of Entries; or (e) any delay experienced by Entrants due to (i) variations in the speed with which different Internet servers or connections receive, send and otherwise process digital information or (ii) any other technical reason, whether due to the nature of digital systems and the Internet or otherwise.
Without limiting anything set forth elsewhere in these Official Rules, in case of any dispute, entries will be deemed submitted by the Authorized Account Holder of the email account specified on the Entry. "Authorized Account Holder" is defined as the natural person who is in control of the email address specified on the Entry. Any Entrant may be required to provide Sponsor with proof that he/she is the Authorized Account Holder of the email account associated with his/her Entry. An Entrant’s Entry will be disqualified, at the sole discretion of Sponsor, if he/she attempts to (a) enter the Contest through any means other than described in these Official Rules; or (b) disrupt the Contest, circumvent the terms and conditions of these Official Rules, or in any way tamper with any component of the Contest. Notwithstanding anything to the contrary contained in these Official Rules, Sponsor further reserves the right, in its sole discretion, to suspend, modify or cancel the Contest, or any portion thereof, if it cannot be run as originally planned, including by reason of tampering, unauthorized intervention or fraud; infection by computer virus; malicious software attacks, bugs or other problems; or force majeure or other causes beyond the control of Sponsor which impair the integrity or corrupt the administration or security of the Contest. In such event, the Contest shall be conducted from among all eligible Entries received prior to suspension, modification or cancellation, if any, prior to the date on which the event that compromised the Contest occurred.
Except where prohibited and subject to the releases and other provisions of these Official Rules, each Entrant: (1) agrees that any and all disputes, claims and causes of action arising out of or connected with the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in St. Paul, Minnesota; (2) agrees that any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred and in no event shall include attorneys' fees associated with participation in the Contest; (3) agrees that no indirect, punitive, incidental, special, consequential or other damages, including without limitation, lost profits, may be awarded (collectively, "Special Damages"); and (4) waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO A PARTICULAR ENTRANT(S).
The Contest and these Official Rules are governed by the laws of the State of Minnesota, without regard to its conflicts of law rules.
CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING WITHOUT LIMITATION ATTORNEYS' FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.
